Fire destroys Rivonia shopping centre

Gauteng: At 13H48 Saturday afternoon Netcare 911 responded to reports of a structural fire in Rivonia. Reports from the scene indicate that a fire had started in a shopping centre restaurant allegedly due to a gas bottle explosion.

On closer inspection most of the building had been gutted by the Fire.

Fire and Rescue Services managed to douse the flames.

A total of seven patients sustained injuries ranging from minor to moderate.

An adult male patient had sustained serious burn wounds and was treated on scene by Advanced life support paramedics.

Once stabilised all the patients were transported by various ambulance services to hospital.

Due to the nature of his injuries the Netcare 1 Specialised Helicopter Air Ambulance was activated to airlift him to a specialised facility for the care he required.

Circumstances leading up to the fire will be investigated by the relevant authorities.

Hawks launch hunt for suspected terrorist in Mpumalanga

The National Christian Resistance Movement is accused of plotting to carry out terrorist acts against national key points, shopping malls, and informal settlements.

The Hawks say they’re searching for a suspected terrorist after arresting the leader of a terror group in Mpumalanga.

Authorities secured an arrest warrant for Riana Heymans who is believed to be part of the National Christian Resistance Movement.

The group is accused of plotting to carry out terrorist acts against national key points, shopping malls, and informal settlements.

Her alleged accomplice Harry Johannes Knoesen appeared in court yesterday on terrorism-related charges.

Hawks spokesperson Hangwani Maluadzi said, “There’s another suspect we’re looking for, Claire Hunt, and we released her picture. We are appealing to the public to assist us.”

Decision on disputed Sea Point property expected in 2020

The long-awaited Tafelberg case ended on Friday after five days in the Western Cape High Court. This matter concerns the province’s decision to sell a Sea Point property to a private day school instead of using the property for social housing.

Reclaim the City and Ndifuna Ukwazi Law Centre took the province and the City of Cape Town to court to address this. The national Department of Human Settlements launched a separate case against the province for not consulting the national minister prior to making the decision to sell. The matters were heard together this week.

Close to 30 spectators watched intently from the gallery.

Advocate Emma Webber spoke for the Social Housing Regulatory Authority concerning the restructuring zones and the obligation to redress spatial injustice.

She addressed the fact that the Tafelberg property was not in a restructuring zone. The national minister decides restructuring zones across the country. Properties in these zones are eligible for a restructuring capital grant from the national government to, for example, build social housing.

The province has used the fact that Sea Point is not in a restructuring zone to explain its decision not to build social housing on the Tafelberg site. The site wouldn’t be eligible for the restructuring capital grant.

But Webber disputed this reasoning. She said that the problem could have been avoided altogether had the province simply conferred with the national minister.

“It is common cause that Cape Town is a spatially divided city,” said Webber, acknowledging the remaining footprint of apartheid. She said that the central business district (CBD) is only a few square kilometres and yet it accounts for 30% of the city’s workforce. She said in terms of spatial injustice, there’s no questioning the need to address housing around the city centre.

“It’s always going to be more expensive to build housing in well-located areas than on the outskirts, but that is what is entailed in this obligation (to address spatial apartheid),” Webber said. “If it’s always cheaper to build on the outskirts, this obligation will never be fulfilled.”

Finally, advocate Pete Hathorn stood up to make closing arguments for Reclaim the City and Ndifuna Ukwazi Law Centre.

Hathorn stated that the price of well-located land and housing is the driving force behind ongoing spatial injustice. “Cape Town is one of the most spatially divided cities in the country separated by race and class.” He said urban regeneration has tended to force low-income earners out of the centre of the city.

“Cape Town still very much resembles the make-up of the city in the 1970s. It is less diverse and more segregated now than it was 50 years ago,” Hathorn said. “The applicants’ rights and the state’s obligations are two sides of the same coin. The state needs to implement a reasonable housing program in central Cape Town.”

He further argued the point of land scarcity in the city. Citing the school’s argument that it could not find another property, Hathorn emphasized the need to utilize the land that’s left. He said the province was “patting themselves on the back” for selling off one of these remaining properties without due consideration for the long-term obligations to transform the city. He called the decision “blindingly short-sighted”.

Hathorn cited a 2011 census that noted 47% of households have a monthly income of less than R3,200. 14% make between R3,201 and R6,400 monthly, 13% between R6,401 and R13,000, 12% between R13,001 and R26,000, and 14% make more than R26,000 monthly.

He then read a section of an affidavit submitted by a former Sea Point resident who has experienced apparent hardships since being forced to move out of the city. “To suggest that someone in this capacity is not deserving of relief of affordable housing is to disregard the hardships she has faced.”

Hathorn responded to the City’s argument that it’s unfair to say they’ve done nothing in 25 years. The City had argued that the Social Housing Act only came into effect in 2009 and SPLUMA, or the Spatial Planning and Land Use Management Act came into effect in 2015. Hathorn noted that this suggests that the obligation only became apparent in 2009, which was not the case pleaded by the City and province who both acknowledged an ongoing obligation to redress spatial injustice, he said.

Advocate Coriaan De Villiers concluded the applicants’ argument and spoke about the restructuring zones. The declaratory relief sought by the applicants is that Sea Point falls within the restructuring zone. She said the notices published in 2011 and 2017 are the designations for restructuring zones that the entire social housing program relied on and one cannot question these zones for the sake of argument in this case.

“You’ve given us lots to think about, it’s going to take time,” said Judge Patrick Gamble. “The normal time period is about three months, but that target is overtaken in this matter. Due to the nature of the papers, May or June is the earliest indication for a decision.”

“This matter has huge ramifications. We would like to encourage the legal representatives and parties not to lose sight that this case has a long way to go. We encourage the parties to engage with each other as much as possible to see if there’s any aspect that can be resolved together.”

Learners must stay until last day – education department

Schools are urged to have programmes set up for their learners after exams. The academic school year is coming to an end and parents have been voicing concerns about educators encouraging learners not to come to school, reports Highway Mail.

End-of-year exams and tests finish at least a month earlier than schools’ official closing date.

If learners are being encouraged to start their holidays early and take off the days leading up to break-up day, then shouldn’t exams finish a lot closer to break-up day?

New-Germany and Pinetown based-schools, such as Lyndhurst Primary and John Wesley School, keep their young learners busy up until the last day with extramural activities and excursions.

John Wesley’s headmaster, Darron Tarr said: “We insist on our kids to stay in school up until the last day. We arrange outings and fun-days for them and start teaching next year’s content,” said Tarr, who indicated that the school was following the law.

“Legally, your child is meant to be at school for 199 days if they’re in a government school and 195 days if they’re in an independent school. Anything less than that is in violation of the law.”

Westville Boys’ High School’s headmaster, Graham Steele, said, “We write exams up until the middle of the fourth term. We also have control tests that contribute to the first term mark for the following year. We also start teaching the learners content for next year at this time.”

Other schools in the upper highway area, like Hillcrest High School, have a full post-examination programme for their learners after exams.

What about schools with minimal facilities? Clermont-based Clernaville Primary School educator Thokozani Luthuli said, “After exams, most learners don’t come to school. We do not have media rooms or playing grounds, so they get bored.”

The department of education’s circuit manager, Doli Myende, explained how difficult the end of the year was for educators.

“Exams can’t end too late because of marking, moderation within the schools and assessment committees that need to award marks accordingly. Schools are encouraged to have post-exam programmes and Grade 11s should start learning content for matric.

“Some teachers also go to matric-marking centres, which starts on 1 December.

“Schools close 4 December,” she said.

Tshwane MMC Sheila Senkubuge resigns following S.e.x tape scandal

The former Mayco member has listed many of her successes but says the storm around her alleged relationship with her boss means it’s time to go.

After a difficult week that started on Sunday with allegations that she had engaged in an extramarital affair with Tshwane mayor Stevens Mokgalapa, Tshwane MMC for roads and transport Sheila Senkubuge has resigned as both an MMC and as PR councillor.

In a four-page letter (which you can read below) she said “attempts to vilify me” were detracting from her work and she did not want this to affect service delivery to city residents.

Mokgalapa took special leave after audio was circulated of him allegedly having sex with Senkubuge while also making several damning comments about his colleagues and political opponents.

They both later denied that they were in a relationship with each other.

Both the ANC and EFF expressed displeasure that Mokgalapa took special leave without consulting council.

A motion of no confidence attempt against him failed to be allowed on Thursday, which opposition parties slammed as an illegal move to delay his removal.

The City of Tshwane also said that they viewed the tape as an alleged extortion attempt against Mokgalapa.

Mayoral spokesperson Omogolo Taunyane said that both Mokgalapa and Senkubuge viewed the recording in “a very serious light”.
The city has claimed that the demands from the “blackmailers” included the immediate reinstatement of four officials who were on suspension for violations of the Municipal Finance Management Act and other relevant statutes governing the conduct of officials of the municipality.

A case of blackmail and extortion had been registered with the Brooklyn police.

“We expect law enforcement authorities to get to the bottom of these attempts to turn the municipality into a bastion of illegal activity wherein leaders are expected to turn a blind eye on such,” said Taunyane.

The Democratic Alliance’s Gauteng provincial leader John Moodey said their political leadership were conducting an internal investigation into the matter.

Uyinene Mrwetyana’s family wants to turn Clareinch post office into wellness centre

The family of Uyinene Mrwetyana, who was raped and murdered by Luyanda Botha at a post office in Cape Town in August, say they hope to convert it into a wellness centre.

But Uyinene’s mother, Nomangwane, was quick to issue a caveat: “… only time will tell.”

This as the family of the slain University of Cape Town student launched the Uyinene Mrwetyana Foundation in Makhanda, the Eastern Cape, on Friday.

Speaking at the launch, Nomangwane said the long-term goal for the family “is to convert the [Clareinch] post office from a place of trauma to a place of healing … yes the very same post office.”

Uyinene’s rape and murder at the hands of Botha angered a nation already grappling with an unparalleled rate of violence against women and children.

Many pinned the reaction to her death, which culminated in the #AmINext movement, down to the fact that it happened while the first-year student was running day-to-day errands – picking up a parcel from the post office.

Botha was handed three life terms by the Western Cape High Court two weeks ago after pleading guilty to Uyinene’s rape and murder. He will not be eligible for parole for 25 years.

Friday’s launch of the foundation was preceded by a solidarity walk through the streets of Makhanda.

“The foundation will enable us to strategically partner with multiple stakeholders in fighting the scourge of gender-based violence and capacitate young people to stand up against women abuse in our communities,” Nomangwane said.

The foundation will focus on gender-based violence prevention, provide holistic support services to survivors and focus on youth leadership development.

The Duchess of Sussex, Meghan Markle, and executive director of United Nations Women Phumzile Mlambo-Ngcuka shared messages of support for the foundation via a video link-up.

This is Why the EFF could hold the key to winning Joburg mayoral race

With the postponement of the Johannesburg mayoral council sitting on Thursday, the EFF could hold a strong hand going into this week’s negotiations with the ANC and DA.

This, despite the failure of its no-confidence motion against embattled Tshwane Mayor Stevens Mokgalapa.

The three major parties have been in a wrestling match over control of Gauteng’s two biggest metropoles in recent weeks.

The cities of Johannesburg and Tshwane both have hung councils, with no party winning a 50% plus one majority in either metro in the 2016 local government elections.

This forced the DA in both councils to enter into coalitions or voting agreements to secure two of the most powerful mayoral positions.

Herman Mashaba’s surprise resignation from the DA last month, as well as Mokgalapa’s recent sex tape scandal, have paved the way for a power grab between the EFF, ANC and DA.

While the EFF is the third biggest party in both the Johannesburg and Tshwane councils, it could use its blocks of seats to convince the DA or ANC to back it for mayor in either of the metros, in return for the support of the red berets in other municipalities.

DA’s turn to back EFF

Last week, EFF leader Julius Malema said it was the DA’s turn to support his party as the EFF had backed the DA in the past.

At the time, he said the EFF would consider a trade-off in Tshwane.

The ANC, for its part, has been tirelessly exploring every avenue to regain power in Johannesburg ever since it lost the city in 2016.

Mashaba’s sudden resignation allowed the national governing party room to explore and woo DA coalition partners in a bid to regain control of the council.

Its bid for power was effectively blocked by the EFF and DA speaker Vasco da Gama.

The EFF in Johannesburg helped bring the DA to power after the 2016 local government elections, voting together on a case-by-case basis. However, at one stage on Thursday, the ANC and EFF seemed to be courting each other.

During intervals in the Johannesburg city council, EFF deputy president Floyd Shivambu was seen huddled in conversation with ANC secretary-general Ace Magashule.

While the two clarified the meetings were purely about the interpretation of numbers it would take to win, the EFF was on several occasions heard by News24 citing the candidacy of Geoff Makhubo as one of the reasons it would refrain from voting with the governing party.

The ANC, EFF and DA deployed their senior leaders to oversee the election in the two major cities.

In Tshwane, the council sitting collapsed following a walkout by the ANC and EFF after a motion of no confidence against Mokgalapa was blocked on Thursday.

Speaker Katlego Mathebe prevented the motion on a technicality, arguing the EFF’s reasons for the motion were not based on fact, but opinion.

Meanwhile, in Johannesburg, the ANC was left fuming after Da Gama postponed the election to December 4, citing a need for legal opinion on the interpretation of the Municipal Structures Act and council regulations on the concept of a majority in council.

Da Gama said council rules stipulated a 50% plus one majority rule during council elections but there was seemingly confusion when read with the act.

The EFF, with 30 seats and an intention to govern one of the two metros, will need to convince either the DA or ANC about a trade-off in Tshwane and Johannesburg.

Moonchild Sanelly lucky to be alive after she was hospitalised

Moonchild Sanelly thinks she cheated death after she was hospitalised with debilitating symptoms of malaria. She contracted the life-threatening disease in Malawi where she had gone to perform at Lake of Stars international festival last month. Despite her near-death experience during her four-day hospitalisation, Moonchild still sees the funny side out of the whole ordeal. Before she was hospitalised, the 32-year-old born Sanelisiwe Twisha had travelled to Los Angeles and Austria unaware she had contracted malaria.

“It was scary. I remember telling myself there is no way this is going to come out and [have people] say, ‘rest in peace Moonchild’,” she recalled.

“I was in and out of consciousness. I was so weak and we initially thought it was just jet lag. So, I was travelling and didn’t know that I had malaria in my system. Apparently when they called the ambulance I was so delirious that I pushed my friend. It was crazy… I got so lucky. Every doctor kept saying your timing was so vital.”

A week after she was discharged, she was forced to return to hospital after she fell extremely ill once again and had to receive blood transfusion. Moonchild Sanelly has been on medical rest for the last month and had to cancel the gigs she had been booked for.

She’s back on her feet again and her usual bounce was all there this week when Sowetan met her. As a result, this weekend she returns on stage for Rage in the City, which also features Riky Rick, Sho Madjozi, Nasty C , Kabza de Small, Shane Eagle and Boity on the line-up. She will perform on day two (tomorrow) of the three-day long music festival in Constitution Hill, Johannesburg.

Six injured in Pretoria rollover

Gauteng: At 04H46 Saturday morning Netcare 911 responded to reports of a collision on the R80 just before the Bremer offramp, Pretoria.

Reports from the scene indicate that the driver of a light motor vehicle lost control resulting in a rollover.

Five occupants of the car including three minor children sustained moderate injuries.

An adult female passenger sustained serious injuries and required Advanced Life Support intervention to stabilise her.
