This is how to get a protection order

With the continuing murders and assaults on a woman in SA, the Western Cape department of community safety has launched a booklet to assist victims of domestic abuse on how to obtain a protection order.

Community safety minister Albert Fritz said a protection order can be a powerful tool in protecting a person’s life and wellbeing if used properly and under the correct circumstances.

“A protection order is an order issued by a court ordering a person with whom one has or has had a domestic relationship, to stop the abuse. It is important that individuals be empowered with the knowledge of their rights pertaining to DV [domestic violence]. This includes understanding what a protection order is and how they can obtain it.”

Fritz encouraged residents to share the information far and wide to ensure that it reaches those who may need it most.
Going forward, the department will implement a range of communications devised to share this information further,” Fritz said.

The booklet assists in defining a domestic relationship and domestic violence, outlining the rights of a victim of domestic violence and the responsibilities of SAPS, defining a protection order and how to obtain it, and providing useful contact details on how to access domestic violence and gender-based violence and femicide (GBVF) related services.

Fritz said that in applying for a protection order it was important to distinguish between the applicant and respondent.

“Victims of DV and GBVF should first report the incident to their local police station. The victim must then apply for a protection order at their local magistrate’s court. In doing so, the victim in the application for a protection order becomes the applicant. The alleged perpetrator in the application becomes the respondent.

“It should be noted that an interim protection order can also be issued at any time of the day or night for protection. Alternatively, if the victim does not have a legal representative, the clerk of the court is obliged by law to inform the victim of relief or remedies available in terms of the Domestic Violence Act.” Said Fritz.

Ngaa Murombedzi, advocacy manager at Women and Men Against Child Abuse, said it cost nothing for the application for the protection order.

“If the interim protection order is granted and delivered to the respondent by the police it is free of charge, however if through the sherriff, you will have to pay. A protection order is granted with a suspended warrant of arrest. In the event that the perpetrator violates the terms of the order they will be arrested,” she said.

Murambedzi said it was important for a victim to provide all supporting evidence as a protection order is granted based on the evidence brought before a magistrate.

She said when approaching a court for a protection order, victims must know that the officer of the law assisting them is under legal obligation to do the following:

 

Give information to the victim about their rights.
Explain the contents of the notice (protection order) that sets out your rights. This explanation must include the remedies that you have in terms of the Domestic Violence Act and your right to lay a criminal charge, if the act committed has an element of violence;
Finding a safe place for you to stay or helping you make arrangements to find a place; and
Getting you medical treatment if required.
Murombedzi said an interim protection order can be applied for by a victim or on behalf of a victim by concerned parties with the written or explicit consent of the victim, unless the victim is a minor, a cognitively impaired individual or unconscious.

“The application on behalf of someone else should explain why the applicant is interested in the wellbeing of the victim as well as their occupation and capacity in which they are making the application. In such a case where someone cannot give consent to have a protection order applied for on their behalf a court has to be satisfied that you absolutely cannot apply for the protection order yourself. The following people can do so: counsellors; health workers; police officers; social workers and teachers,” Murambedzi said.
Step by step guide to obtaining a protection order

Step 1: Report the complaint to a local police station

Step 2: Apply for a protection order at a magistrate’s court

Step 3: A magistrate considers the application

Step 4: An interim protection order may be granted and will be served on the respondent

Step 5: Court proceedings or hearing of evidence to determine whether a final protection order should be granted

Step 6: Consequences for the respondent if he/she violates the conditions of a final protection order.

Murambedzi said they have had many cases where protection orders taken out to protect families and children from violence were contravened more than they were adhered to.

“The application of protection for children and victims of domestic violence within our country is sorely lacking and so dismal that often victims of domestic violence are discouraged in opening a case or reporting their ordeal. It is upon the victim to show they need protection — should a respondent not respond to the protection order by way of signing, that protection order is not implemented unless a magistrate sees the situation merits the court to act on behalf of the victim,” she said.

Renowned photographer Jürgen Schadeberg has died

Jürgen Schadeberg, the photographer who took the iconic picture of former president Nelson Mandela looking through the bars of his cell on Robben Island, has died. He was 89 years old.

The Photographers Gallery in London voted that picture one of the 50 most memorable images of the 20th century.
Sadly Jürgen passed away yesterday (Saturday) due to stroke/age related issues. He was 89, had a full life and his photos will live on,” his wife Claudia said.

Born in Berlin, Germany, in 1931, Schadeburg moved to South Africa in 1950 and took up a position at Drum magazine.
During this period, Schadeburg’s work captured pivotal events in the South African anti-apartheid struggle. Among the biggest of these were the Defiance Campaign in 1952, the Sophiatown forced removals and the funeral of the Sharpeville massacre victims in 1960.

He also captured fabulous images of the vibrant Sophiatown jazz scene, with Hugh Masekela and Miriam Makeba being among the big names he photographed.

During the 60s and 70s Schadeburg freelanced in Europe and the United States and his photographs graced the pages of many prestigious publications.

Schadeburg and his wife produced 15 documentaries about South Africa’s history, incorporating politics, culture and society.

He also published a number of books, including “The Fifties People of South Africa”, “Mandela & The Rise of the ANC” and “Voices from Robben Island”.

Drama at Lebogang Khitsane’s funeral as his Wife and sister get into a fight – Video

Lebogang Khitsane, the man behind South Africa’s ostentatious tombstone designs has been described as an innovative and creative businessman.

Bataung Legacy tombstones are renowned across Africa for their flamboyancy.

They were used for the graves of many well-known personalities including Joe Mafela, Mandoza, Robbie Malinga, kwaito star Senyaka, soccer player John Shoes Moshoeu, and boxer Baby Jake Matlala.

Khitsane died on Thursday from renal failure.

His children have described him as a devoted and loving father.

“Thank you for your unconditional loud and unwavering love. Thank you for feeling like a sun. You were warm energetic and so comforting. Thank you for your forgiveness,” Daughter Tswelelopele Khitsane said.

Ekurhuleni mayor Mzwandile Masina’s also paid tribute to his childhood friend.

“He defied all the odds in the business world. He changed and revolutionised the tombstone industry,” Masina said.

However, there was some drama during the memorial service when his sister, Semati Moedi made shocking claims.

Khitsane, who once said he wanted to be remembered as “the Steve Jobs of tombstones”, will be laid to rest on Tuesday.

All eyes on ANC’s Integrity Commission Unit

Amid intensifying internal factional battles and the 2017 election campaign being at the centre of the storm, those who lead the ANC’s Integrity Commission (IC) have been left with no choice but to prove the structure is still relevant and not feeble.

The commission is being watched closely to see how it will muscle in top leaders who have corruption allegations hanging over them.

This comes as the party’s national executive committee (NEC) has reiterated its stance that all those accused of malfeasance should subject themselves before the IC.

President Cyril Ramaphosa has already raised his hand to face the music over his CR17 presidential campaign after facing mounting pressure to do so, and it is believed that on Sunday he dared others to play open cards and declare their financial interests.

Reports also emerged at the weekend that senior NEC member Tony Yengeni had asked Ramaphosa to step down.

Several others have since supported the motion for Ramaphosa to resign. But some have vowed to push back on calls for the ANC leader to walk the plank.

ANC provincial secretary in Limpopo Soviet Lekganyane came out in support of Ramaphosa and warned against moves to oust him.

Speaking at the funeral of MK veteran David Malada at the weekend, Lekganyane said they would thwart moves to remove Ramaphosa.

“We must be ready and it must be known that the fightback will not get off the ground,” he said.

Meanwhile, as the NEC meeting was expected to wrap up on Sunday, it is yet unclear how the IC’s processes will unfold or when it is set to begin.

However, what has been clear is that the battle lines have been drawn as factional rifts heat up over who should be hauled over the coals for their part in corruption – particularly over the looting of Covid-19 relief funds.

On the other hand, some experts believe that the IC is all talk and no bite.

“The commission always makes pronouncements and recommendations but the current leadership ignores those calls. For example, the commission recommended that the Deputy Minister (of Finance) David Masondo step aside but the ANC leadership just ignored that recommendation instead of following it up and ensuring that it is implemented,” political commentator Xolani Dube said.

He added that the IC was toothless and that the expected appearance of top leaders before it was unlikely to result in removals of people from their posts.

Last week, Ramaphosa penned a seven-page letter to ANC members in which he said the ANC was in the dock as “Accused No 1” in relation to corruption allegations.

The letter has, however, resulted in factional tension within the party as it earned him condemnation from his detractors, including former president Jacob Zuma.

SA COVID-19 death toll exceeds 14 000

The health department reported 47 COVID-19 related deaths in the last 24 hours.

This takes the total death toll to 14,028.

Sixteen patients died in Gauteng, 11 in Mpumalanga, seven each in the Eastern and Western Cape and three each in the Free State and KwaZulu-Natal.

Gauteng, KwaZulu-Natal and the Free State have the most active cases.

The number of new cases in the country increased by 2,505 in the last 24 hours.

South Africa now has a cumulative total of 625,056 confirmed COVID-19 cases.

The recovery rate remains at 86 percent.

The number of tests done is 3,674,872 with 21,902 new tests.

Comrades champion Nick Bester attacked

Comrades champion Nick Bester has been seriously injured in an attack while training outside Pretoria.

Fellow Comrades champion Bruce Fordyce says Bester was beaten with rocks, dragged up a hill, tied up and left for dead.

His bicycle was also stolen. Bester had to crawl through the bush to get help. He was training for the Battle of the Sports event at the time.

Fordyce says Bester has broken ribs, a broken jaw and he has deep cuts to his head.

Herman Mashaba vows to prioritise curbing corruption and reforming the police

Action SA leader Herman Mashaba said curbing corruption and reforming the police features high on his new party’s agenda.

South Africans will now have one more option on their next election ballot following the launch of Mashaba’s new political party.

In a bid to unseat the African National Congress, the former Mayor of Johannesburg lobbied support from former members of the Democratic Alliance and the African National Congress itself.

Speaking at the virtual launch of Action SA on Saturday, Mashaba promised to re-establish the now-defunct scorpions to fight corruption.

“Our police force needs to be restructured to become a modern crime-fighting machine. We have to remove the political interference that cripples our police. We need specialized units to tackle priority crimes in South Africa, including the re-establishment of the Scorpions.”

Mashaba said the country’s citizens were still suffering despite 26 years of democracy as corruption continues to go unpunished.

“If you want to see our politicians in jail for corruption or the likes of the Guptas extradited in South Africa to face charges, then you have found your political home.”

Action SA plans to contest national elections, starting with local government polls next year.
