Mariah Carey responses to elder brother’s lawsuit against her

Mariah Carey has hit back at her brother’s defamation lawsuit, claiming it was in the public interest for her to talk about him in her 2020 memoir.

Mariah’s older brother, Morgan Carey, took legal action against the singer earlier this year after he claimed she featured “malicious falsehoods” about him in her book, “The Meaning of Mariah Carey”, which was released last year.

Morgan accused Mariah of defamation and the intentional infliction of emotional distress following the release of the memoir, in which Mariah recounted a vicious fight between Morgan and their father, and said her brother was institutionalised when he was younger.

Mariah also wrote in her book that she “never felt safe” around her “troubled brother” because of his “unpredictable” rage.

But now, the “We Belong Together” hitmaker has now filed papers with the Manhattan Supreme Court to state her claims are not defamation, since the book’s message of her personal triumph over adversity is a matter of public interest.

Mariah’s claim means that a higher legal standard would be required of Morgan to prove defamation, and the singer claimed in her papers – which were filed on Friday – that Morgan lawsuit doesn’t meet those requirements.

The 51-year-old star says her story is of public interest because of her fame, and because she wanted to encourage young people who also face difficult upbringings.

Court papers obtained by Page Six read: “The story of Ms. Carey’s rise from a dysfunctional and sometimes violent family environment has significant public value, particularly to any young person who may find her/himself stuck in similarly harsh and dispiriting circumstances and who can benefit from the inspiration to employ their talents in pursuit of their dreams.”

In Morgan’s original filing, the man claimed that, as a result of the publication of the memoir, he has “suffered extreme mental anguish, outrage, severe anxiety about his future and his ability to support himself and his family, harm to his reputation and his earning capacity, embarrassment among his friends and associates, disruption of his personal life and loss of enjoyment of the ordinary pleasures of everyday life.”

And the suit argued that the damage allegedly caused by the ‘Fantasy’ singer was intentional, citing a pre-publication interview she did with Oprah Winfrey.

It stated: “She intended to damage plaintiff, stating ‘he drew first blood.’ She also publicly referred to plaintiff as her ‘ex-brother.’”

Morgan is not seeking a specific sum in compensation but is looking to undo damages through “judicial determination”.

Shock as dead body found being eaten by dog from a shallow grave

Cops in Cape Town are investigating after a decomposed body was found in an open field in Siteview, Grabouw, on Sunday.

According to a resident, the body was found when a passerby saw a dog feasting on the body, from a shallow grave.

The passerby was walking in the secluded area when he saw a dog eating something and decided to check what it was, only to find a human body.

“The body seems like that of a female person who was wearing slippers. I did not sleep properly after seeing that body and I don’t think I will ever erase it from my mind. People are shocked because it is not known whose body it is and what transpired. It is also shocking to see a dog feasting on a human being,” said.

Tonderai Dube, who lived close to where the incident occurred.

He said when he arrived at the scene, cops had not arrived and he managed to see the state of the body.

“The person who saw this incident ran and told community members who then went to witness the shocking scene. The body was in a decomposing state and the person could not be identified. I have never witnessed such a scary scene in my life,” said Dube.

Cops were still investigating the incident and a murder case had been opened.

Spokeswoman Sergeant Noloyiso Rwexana said no arrests had been made yet.

“Grabouw police have opened a case of murder after an unidentified decomposed body was found buried in an open field in Siteview, Grabouw, yesterday morning. The gender will be determined once a postmodern is conducted. The circumstances surrounding the incident are under investigation with no arrests so far,” she said.

Police officer gets his job back 10 years after being wrongly jailed

Ten years after he was axed on the back of what later turned out to be a wrongful conviction for indecent assault, an Eastern Cape police captain has finally won back his job.

The Elliot Regional Court in 2010 found Captain Meshack Phopho guilty of having indecently assaulted a woman who assisted at the Maclear police station, where he was based.

Early the following year, he was sentenced to five years in prison.

Despite a disciplinary inquiry having previously found him not guilty, the court outcome also wound up triggering Phopho’s dismissal from the Saps.

Phopho took the case on appeal, though, and was ultimately successful.

In November 2014, the Eastern Cape High Court set aside both his conviction and sentence.

But when Phopho subsequently tried to apply for reinstatement in the Saps, he was told he had missed the deadline of 30 days from the date of the judgment and sent packing.

This despite the fact that on his version and that of his lawyer, they had only been notified about the judgment three months after it was handed down.

In 2019, the Labour Court in Gqeberha found former police commissioner Riah Phiyega – who took the decision to refuse Phopho’s reinstatement – “had not applied her mind to the application” and that her decision was neither reasonable nor rational.

It remitted the matter back to the Saps for reconsideration, prompting the Saps to turn to the Labour Appeal Court.

Not only did the appellate court last week dismiss their bid to overturn the ruling, it also partially upheld a cross-appeal from Phopho and replaced the previous order with one directing the Saps to reinstate him – no questions asked – retrospectively and “with no loss of rank, salary, allowances, privileges or benefits”.

The police had argued the 30- day limit was necessary to ensure finality in internal disciplinary cases.

But Judge Phillip Coppin in last week’s ruling said this line didn’t stand up to scrutiny.

“It appears unreasonable and constitutionally unpalatable to impose a time limit that neither allows for condonation, nor allows for the possibility that a member may [conceivably] reasonably not be able to comply with the time limit, for example in circumstances where the member was not and could not reasonably have been aware of the date of the judgment and only became aware of it later,” the judge said.

“The time limit is palpably not fair and does not give expression to the values which underpin the constitution. To uphold their argument would not promote the spirit, purport, and objects of the Bill of Rights.”

Ex-Eskom executives back in court for R745 million Kusile corruption case

Two former Eskom executives and their three co-accused are expected to appear in the Palm Ridge Specialised Commercial Crimes Court on Tuesday morning in connection with Eskom’s R745 million Kusile power station corruption case.

The power utility’s former group executive for the group capital division, Abram Masango, former contracts manager, France Hlakudi, businessman Maphoko Kgomoeswana, and Tubular Construction CEO Antonio Trindade face various charges including fraud, corruption, and money laundering related to the construction of the multibillion-rand power plant.

At the last court sitting, Magistrate Philip Venter urged the media to send through their applications to film proceedings of the trial. The defence had made an indication that they plan to oppose media filming.

Former Tubular holdings advisor, Michael Lomas, will not be in court as he is still in the United Kingdom. He is expected to appear in the London Westminster Magistrates Court from 20 to 21 December 2021 for his extradition trial.

This after the NPA’s Investigating Directorate (ID) brought an extradition application through the UK central authorities to invoke the European Convention on Extradition 1957, and the UN Convention against Corruption 2003, to assist in bringing Lomas back to South Africa.

Lomas made a brief second appearance at the London court last week following his arrest in April. He was granted bail of R1.7 million and surety in the sum of about R4.3 million, among other stringent bail conditions.

Peru’s newly revised Covid-19 death toll now worst in the world

Lima – Peru on Monday almost tripled its official Covid-19 death toll to 180 764, following a government review, making it the country with the worst death rate per capita, according to Johns Hopkins University data.

Peru has been among the hardest hit Latin America countries during the Covid-19 pandemic, with its hospitals overcrowded with patients and demand for oxygen outstripping availability. Experts had long warned that the true death toll was being undercounted in official statistics.

The government said it will now update its death count, which stood at 69 342 as of Sunday, in part because of a lack of testing that made it difficult to confirm whether a person had died due to the virus or some other cause.

According to Johns Hopkins data, Hungary had the worst number of per capita Covid-19 deaths at about 300 per 100 000 people. With its updated death toll, Peru now stands at more than 500 Covid-19 deaths per 100 000 people.

“We think it is our duty to make public this updated information,” said Peru Prime Minister Violeta Bermudez during a news conference announcing the result of the review.

In Latin America, Brazil has the highest total death toll with more than 450 000 lives lost due to the pandemic. Based on population, however, Peru’s per capita death toll now more than doubles that of Brazil, according to the data.

Peru’s updated numbers are in line with so-called excess death figures, which researchers have used in Peru and other countries to measure possible undercounting during the pandemic.

Excess deaths measures the total number of deaths over a period of time and compares it with the same period pre-pandemic.

Skeem Saam actor and businessman Clement Maosa whose always been vocal about losing his parents at a very young age recently took to social media to share a snap of his birth parents on the day they celebrated their engagement. Clement reflected on how their death came about so sudden and he and his siblings did not even get time to mourn.

This was their engagement celebration before the wedding, and immediately after the celebration they both started having health issues then eventually passed on a year later. I was young but I heard all kinds of accusations/allegations from everyone, community members, family, church people and just passerby what was the cause of their deaths and as a teenager I was confused and the family war erupted and we didn’t even get the time to grief or mourn as everything happened so fast… the only solution was to relocate with my siblings from that village, switch off the noise and somehow started afresh.” Shared the actor.

Chatting about his healing process, Maosa revealed that at a point, he felt that maybe their decision to get married was the one that cost them their lives and felt that had they not gone on with the decision maybe they’d still be alive.

Healing is a process and no one should predict when and how to deal with it. The fact that two domestic workers who were already written off were now emerging in business and had a white wedding in the village didn’t sit well with many for some weird reason, at some point I believed that had they not get married and had a huge wedding celebration they would still be alive… anyway it’s all in the past now I’m just rewriting history that’s all. Tlou & Mosima Maosa engraved on my heart for eternity.”

Celebrating his 34th birthday in April 2021, the actor thanked his adoptive mother for the man he’s grown up to be and attributes all his success to her.

At the age of 21 I obtained my LLB degree and immediately got my first tv break and since I never looked back but through it all this here Queen gave me and my siblings the greatest love a human can ask for after both my parents passed on,” posted Maosa in part.
